APPROVAL OF MINUTES
1. Approval of Minutes January 7, 2008 - Regular Meeting

2. PUBLIC HEARING - REQUEST BY CHARLES HUGHES FOR BILLY & PEGGY LAWRENCE TO REZONE 19.61 ACRES FOR SUBDIVISION, MIMOSA LANE
#0800843 - Request by Charles Hughes, III, developer for Billy and Peggy Lawrence of Mimosa Lane is to rezone a 19.61 acre portion of existing property from A-1, Agricultural to R-SF, Residential-Single Family for a proposed 10-lot residential subdivision in the Rustburg Election District. (Advertisement for Public Hearing attached.)
RECOMMENDATION: The Planning Commission recommends approval of the request by vote of 7-0 and citing good zoning practice.

3. Permission to Advertise - Rehabilitation Exemption Ordinance (5 minutes)
The County has received a request from Waverly Coggsdale, Town Manager of Altavista, that the County consider adopting an ordinance that allows a partial real estate tax exemption for commercial buildings in order to support the Town's downtown revitalization efforts. Buildings that have been rehabilitated such that their assessed value is increased by any amount without increasing the building's square footage by more than 15% would be allowed to apply for the exemptions. The exemption is only for that portion of the value of the new improvements for a period of five years. The Virginia Code provides that a locality may do so at section 58.1-3221. Altavista passed such an ordinance applicable to the town taxes in August 2007. Altavista's request and its ordinance, along with the enabling Virginia Code statute, are attached. For your information please see information item #30 below for an update of the Town's downtown revitalization efforts to date.
RECOMMENDATION: Staff recommends the Board approve advertisement of the proposed ordinance for inclusion with the regular Spring 2008 County Code updates.
4. Permission to Advertise -- Biosolids Ordinance Update (5 minutes)
On April 17, 2007, the County passed an ordinance regulating biosolids. Staff sent a copy of the newly-passed ordinance to the Virginia Department of Health for its review. In response, a lengthy list of suggestions for changes to the ordinance, both necessary and discretionary, was received. In addition, staff has heard suggestions for changes to the ordinance from citizens, as well as from the Board itself.
The bulk of the proposed amendments to the biosolids ordinance are changes directed by the VDH. The remaining changes are minor amendments clarifying certain aspects of the ordinance suggested by citizens and the VDH. In addition, all references to "sewage sludge" have been changed to biosolids, both at the suggestion of the Board and the VDH.
The full text of the ordinance with proposed changes is included with this memorandum. Also attached is the response and suggestions from the Virginia Department of Health, a copy of the model VaCo ordinance to which the VDH letter refers, and suggestions from Lorraine Potter, a citizen.
RECOMMENDATION: Staff recommends the Board consider the draft changes made to the biosolids ordinance based on the VDH recommendations and regulation updates, and consider those suggestions made by Mrs. Potter. Additionally, staff recommends the Board authorize staff to advertise the proposed changes noted in the draft ordinance for update during the County's regular Spring code update.
